Land & Groundwater Contamination Management

Recognising the importance of environmental protection, the Environment Authority has established regulatory frameworks including Royal Decree 114/2001 (Conservation of the Environment and Prevention of Pollution), Ministerial Decision No. 145/1993 (Wellfield Protection), MD 48/2017 (Waste Management), and MD 18/93 (Hazardous Waste Controls) to govern activities that may impact soil and groundwater. Built around the legal requirements, Five Elements provides a suite of services to support clients manage their contamination and pollution risk through baseline surveys such as ‘zero soil surveys’, as part of their standard operating procedures or when the ownership of industrial land changes.

Environmental Due Diligence
Change of land ownership of brown field sites requires that the condition of soil and groundwater be assessed to validate its status with respect to contamination in order to manage related liabilities. This is accomplished through surveys governed by standards such as ASTM Phase 1 and Phase 2 assessments depending on the history of land use at the site, together with an assessment of land use sensitivities in the surrounding area.

Remediation and Light Non-Aqueous Phase Liquid (LNAPL) Management
Should an accidental release or spill occur a remediation plan must be designed and implemented, to manage soil and groundwater contamination to the acceptable legal requirements.

Zero Soil Survey
Industrial land within the mandate of OPAZ (i.e., industrial estates, special economic zones and free zones) require that a zero soil survey (ZSS) be conducted prior to the development of green field sites that serves as the baseline against which an environmental site assessment will compare contamination levels at the end of the tenancy period.
